Event Terms and Conditions

These Event Terms and Conditions (“Terms”) apply between Ministry of Testing Limited (“MoT”, "us", “we” and "our") and any person who purchases or registers, or for whom a third person purchases or registers (“Attendee”), a ticket for any event or conference (for example, TestBash conference, London Tester Gathering Workshops, Masters of the Ministry course) organised by MoT (“Event”).

By registering for an Event, the Attendee agrees to and is bound by these Terms, which form a binding legal contract between the Attendee and MoT. If you are registering on behalf of another individual, it is your responsibility to ensure the Attendee is aware of these Terms and accepts them. By completing the registration on behalf of another individual you are warranting that you have made the Attendee aware of these Terms and that they have accepted these Terms. In any case, the Attendee is considered to be bound by the Terms upon receipt and acceptance of the ticket.

These Terms should be read alongside, and are in addition to, our Event Privacy Policy and Code of Conduct. If you have any questions about these Terms or our other policies referenced in these Terms please contact us at events@ministryoftesting.com. If, for any reason, the Attendee does not agree to these Terms, please do not register for our Events.

COVID-19 Event Safety Measures

Our measures and policies relating to COVID-19 restrictions are constantly being monitored and can be changed at any time.

Ministry of Testing's in-person events will follow the venue's and local government guidelines. Local government guidelines as well as any additional venue measures beyond the ones outlined by the local governments will be communicated to all attendees before the event date. If an attendee misses this communication, it is the attendee's responsibility to check the government and venue's requirements before the event and prepare for this if required.

In an effort to minimise the spread of the virus, we recommend that everyone take a lateral flow test the day before or of the event, regardless of having any symptoms. If positive, contact us straight away and isolate yourself immediately.

In the UK, lateral flow testing continues to be available free of charge. You can get tests from pharmacies or online. Find out more about how to get rapid lateral flow tests.

Who May Register For Our Events

A prospective Attendee may register for an Event if they have the power to enter a binding contract with us and are not barred from doing so under these Terms or any applicable laws. Anyone registering for an Event under the age of 16 is strictly prohibited.

Tickets

Tickets can be registered and purchased through our third-party service providers. A registered or purchased ticket is delivered in an electronic soft-copy format to the email address of the purchaser or to the email address assigned by the purchaser to the ticket. By purchasing or registering a ticket, the Attendee consents to the processing of their personal data in accordance with our Event Privacy Policy.

Provided that the ticket fees have been duly covered, the ticket is considered as giving the Attendee a personal revocable license to attend the relevant Event, except TestBash X and Testbash Home Events where the ticket is considered as giving the Attendee a personal irrevocable license to attend the relevant Event. The ticket acts as a receipt for the transaction and can be used to redeem entry at the Event listed on the ticket. A printed hard-copy ticket is considered equivalent to an electronic soft-copy ticket for redeeming entry to an Event.

The ticket is for the personal use of the Attendee who has purchased or registered the ticket or who has been assigned upon its purchase or registration as the Attendee. The ticket of the Event remains the legal property of MoT and may not be re-sold or transferred to third-parties under any circumstances, either for commercial gain or not, without the consent of MoT.

Payment and Invoicing

Ticket details and fees are set out on the relevant Event registration web page and registration forms through our third-party event management service provider, namely Tito. Prices may be subject to change from time to time.

Payments may be made online at the time of registration through our third-party payment service providers via credit card or PayPal. Alternatively, payments can be made by invoice. An invoice can be requested at the time of registration and will be emailed to the email address provided on the registration form. Invoice payments are due within 30 days of receipt of the invoice or in advance of the Event date, whichever is sooner and regardless of registration date.

Please be aware that payments may carry an international service charge for cross border transactions (i.e. where you are in a different country to the Ministry of Testing Ltd company which is a registered in the United Kingdom) depending on the transfer details. This is generally between 1-3% of the purchase total, but it may be higher. It is your responsibility to be aware of the international service charges that your country, bank, intermediary banks or card provider may charge. We do not take receipt of these fees so we are unable to refund them in any way.

Without full payment of registered tickets, Attendee access to the Event will be denied and MoT shall have no liability in that regard.

Discounts

There are a number of early registration discounts (e.g. blind bird, super early bird or early bird) and partner discounts (e.g. Professional MoT Members or certain Event sponsors) that may be available and used when making Event registrations. An early registration discount can be used in conjunction with a partner discount. These discounts are applied through ticket selection and discount codes when registering.

Groups of 5 or more Attendees may be eligible for a group discount. If you want to purchase tickets for a group, please contact events@ministryoftesting.com with details of the Event in question and the number of prospective Attendees to get more information about the conditions for a group discount. Please contact us BEFORE you register for an Event.

Attendee Changes, Cancellations and Refunds

An Attendee unable to attend the Event is welcome to reassign their ticket to another individual in their organisation at no extra cost provided that we have at least one week’s prior notice of the name of the substitute Attendee, the substitute Attendee is aware of these Terms and accepts them, and we have received full payment of the ticket. Tickets can be reassigned through the ticket confirmation email by selecting “Change Details”.

An Attendee can not cancel tickets to online TestBash Events and no refunds will be made under any circumstances, Cancellations for all other Events, excluding the aforementioned Event types, can be made up until 45 days prior to the Event start date, whereby MoT will offer the Attendee a refund of the full paid fee less a 15% administration fee. Hereafter, no refunds will be made including in instances of non-attendance or late arrival.

COVID-19 Refund Policy

If your ability to attend the event in person is impacted by:

  • local government restrictions related to COVID-19

  • your country’s travel restrictions

  • developing COVID-19 symptoms

  • a requirement to self-isolate

  • event reschedule, and you are unable to make the new dates

You will be able to transfer the total value of your registration to a colleague, to a future event or request a refund (minus 15% of administration fees).

In the case of testing positive for COVID-19, developing symptoms of COVID-19 or being requested to self-isolate due to close contact with someone who tested positive, we will require proof of a PCR test done up to 2 days after the event date in order to receive a refund. A refund will only be issued once satisfactory evidence of the test has been provided.

Travel, Accommodation and Visas

Tickets do not include accommodation or transport to or from an Event. MoT does not make transport or accommodation arrangements for the Attendee nor reimburse the respective expenses. All transport and accommodation arrangements are on the responsibility and cost of the Attendee.

MoT is not responsible for the granting of any visas that are required to attend an Event. Failure to receive a visa does not constitute a basis for any refund of ticket fees.

Code of Conduct

All Attendees at our Events (including hosts, organizers, speakers, sponsors, helpers etc.) are to read, accept and abide by the Code of Conduct. Breaches of the Code of Conduct are taken seriously and may result in the removal of an Attendee from an Event and being banned from attending future Events without liability on the part of MoT.

Photography, Audio and Video Recording

For promotional purposes, there may be a professional photographer and video production taking place during an Event. Attendees who do not wish to be filmed or recorded should advise MoT by email to events@ministryoftesting.com prior to the Event.

Attendees are permitted to take photographs, but not to film or undertake any other recording of talks, workshops or presentations at an Event. Any filming or recording of this nature at an Event, without the prior consent of MoT, will be deemed a breach of copyright and MoT reserves the right to take appropriate action if we become aware of such activity.

Attendees are welcome to make use of social media before, during and after an Event, subject to the above.

Intellectual Property

All intellectual property rights in and to an Event, Event presentations, and all materials distributed at or in connection with an Event (including, but not limited to, any audio-visual recording of Events) (“Content”) are owned by MoT or are included with the permission of the owner of the rights. Attendees shall not distribute, reproduce, modify, store, or transfer any of the Content.

The Content does not necessarily reflect our views or opinions. Suggestions or advice contained in the Content should not be relied upon in place of professional or other advice. You should verify the accuracy of any information in the Content before relying on it.

The Content is provided on an “AS IS” basis without any warranties of any kind. We hereby exclude to the fullest extent permitted by law all liabilities, costs, claims, damages, losses and/or expenses arising from any inaccuracy or omission in the Content or arising from any infringing, defamatory or otherwise unlawful material in the Content.

To the extent that any Content is made available by us on our Services we reserve the right to suspend or remove access to such Content at any time.

Content Advisory

The Attendee understands that at an Event expletives may be uttered. The Attendee considers themselves forewarned in this regard. The views and opinions expressed at an Event may not necessarily reflect the views of MoT. MoT does not accept liability for advice given, or views expressed, by any speaker or Attendee at an Event.

Event Privacy Policy

MoT is committed to protecting the privacy of its Event Attendees. MoT does not rent, share, or sell Attendee contact information or other personal information to any third-parties. You can read the details of how MoT collects and uses Attendee information in our Event Privacy Policy.

Event Programme

MoT reserves the right to make cancellations, substitutions and alterations in the speakers, topics and schedule of an Event programme when necessary. All changes are announced on the corresponding Event web page, our social media channels and/or at the Event. Such changes do not constitute a breach of contract by MoT and do not trigger any liability on the part of MoT.

Accessibility Services

MoT is committed to making all reasonable arrangements that will allow all Attendees to participate in Event activities where possible. Some of our Event venues are wacky or are listed buildings, meaning that meeting certain accessibility requirements is not always straightforward or possible. Attendees who require onsite assistance during an Event should contact us by emailing events@ministryoftesting.com.

Governing Law

These Terms and all other policies issued by MoT, and the relationship between the Attendee and us shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Any or all disputes arising between the Attendee and us (whether contractual or non-contractual) in connection with an Event, including as to the validity of these Terms or policies issued by us, will be subject to the exclusive jurisdiction of the courts of England and Wales. For any dispute between the Attendee and us, the Attendee agrees that they will first attempt to resolve it with us informally. In the unlikely event that we are unable to resolve the dispute in this manner within 28 days of the dispute being notified in writing, the Attendee and MoT both agree to submit to the exclusive jurisdiction of the courts of England and Wales to resolve any such disputes.

Liability

MoT will not be liable for any loss, injury or damage to any Attendee or property howsoever caused at or in connection with an Event, save for the type of liability that cannot be excluded or limited under the applicable law. We advise Attendees to arrange appropriate insurance cover in connection with their attendance at our Events.

MoT may in exceptional circumstances need to cancel or postpone an Event, in which case we shall notify the Attendee as soon as reasonably practical. In the event of cancellation, the Attendee may request a credit or refund. In the unlikely event of cancellation or postponement of an Event, the liability of MoT is limited to the share of the paid ticket fees that remain after payment processing fees have been incurred and deducted. Besides a refund of ticket fees, MoT is not responsible for any loss or damage to or expenses incurred by the Attendee as a result of such cancellation or postponement. In the event of postponement, the Attendee may request to reregister for the rescheduled Event, transfer to another Event, a credit or take the refund.

MoT accepts no liability if an Event, in whole or in part, is cancelled or postponed, or for any failure or delay to perform our obligations under these Terms, due to a force majeure event, meaning any cause beyond our reasonable control including without limitation, acts of God, war, insurrection, riot, civil disturbances, acts of terrorism, fire, explosion, flood, theft of essential equipment, malicious damage, strike, pandemic, communicable disease outbreak, lock out, weather, third party injunction, national defence requirements, acts or regulations of national, local governments or anything else that renders performance of an Event, in whole or in part, impracticable, illegal or impossible.

The Attendee is fully responsible for all damages, losses, costs and expenses, including legal fees, suffered by MoT as a result of any breach of these Terms by the Attendee.

Indemnity

To the greatest extent permitted by law, the Attendee agrees to protect, indemnify, defend, and hold harmless MoT, our employees, co-hosts and helpers, the Event venue, where the Event is being held, and their respective employees, officers, directors, and agents against all claims, losses, or damages to persons or property, governmental charges or fines, and costs (including reasonable attorney's fees) arising out of or connected to the actions or failure to act in accordance with these Terms by the Attendee, its employees, officers, directors, or agents, except those claims arising out of the other party's gross negligence or willful misconduct.

Waiver and Severability:

Any delay or failure by us to enforce any right or provision we may have under these Terms, or the policies referenced in these Terms, will not be considered a waiver of those rights. If any right or provision of these Terms, or the policies referenced in these Terms, is found to be illegal, invalid or unenforceable by any court of competent jurisdiction, the remaining rights and provisions will remain in effect.

Entire Agreement

These Terms, the Event Privacy Policy and the Code of Conduct set out the entire agreement between the Attendee and us regarding an Event, and supersede and replace any prior agreements we might have between the Attendee and us regarding an Event to the fullest extent permitted by law.

Updates & Amendments to these Terms

We may update or amend these Terms (as well as any other policies we issue) from time to time to comply with the law or to meet our changing business requirements, with or without notice to you.
